Question 3: Governmental Entity Discrimination Prohibited

What will appear on the ballot?

“Governmental entity discrimination prohibited. Shall section 27 of article I of the constitution be created to prohibit governmental entities in the state from discriminating against, or granting preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in public employment, public education, public contracting, or public administration?”

What would this amendment do?

This amendment would create a new section of Article I of the Wisconsin Constitution.

The proposed language would prohibit governmental entities from discriminating against, or granting preferential treatment to, an individual or group on the basis of race, sex, color, ethnicity, or national origin in:

  • Public employment
  • Public education
  • Public contracting
  • Public administration

The proposed amendment defines "governmental entity" broadly. It includes state and local governments, the University of Wisconsin System, the Technical College System, public colleges and universities, public school districts, and other governmental bodies.

The proposed language also includes exceptions concerning eligibility for federal programs, certain bona fide qualifications based on sex, and conflicts with the U.S. Constitution or federal law.

What would a "Yes" vote mean?

A Yes vote would create the proposed constitutional provision prohibiting governmental entities from discriminating against or granting preferential treatment to individuals or groups on the specified bases in public employment, education, contracting, and administration.

What would a "No" vote mean?

A No vote would leave the Wisconsin Constitution unchanged by this amendment.

Additional context

The proposed constitutional language is broader than the short question printed on the ballot. Voters who want to examine the proposed constitutional text should review the full language before making their decision.
